The San Francisco Board of Supervisors tentatively selected City Administrator Ed Lee as interim mayor Friday.

Lee appears poised to replace outgoing Mayor Gavin Newsom following a 10-1 vote during Friday's board meeting.

Newsom, who will be sworn in as the state's lieutenant governor sometime before Monday, has said Friday's vote will be merely "symbolic" since the nomination won't be official until he leaves office.

Newsom has pushed back the Jan. 3 date of his swearing-in as lieutenant governor, saying he has more to accomplish while in office.

Progressives have argued that he simply wanted to prevent the current 11-member board from appointing an interim mayor with a far-left political agenda.

Four new board members will take office on Saturday, and the board is expected to officially select the interim mayor on Tuesday.

Lee has served as city administrator since 2005 and has also served as director of the city's Department of Public Works and the Human Rights Commission.

An earthquake with a preliminary magnitude of 4.1 struck east of San Jose this afternoon and could be felt throughout much of the Bay Area, according to the U.S. Geological Survey.

The quake was reported at 4:10 p.m. in an area just south of Mt. Hamilton and 13 miles east-southeast of San Jose City Hall, according to the USGS.

The tremor had a depth of 4.4 miles, the USGS said.

People in the East Bay and San Francisco reported feeling the quake.

BART briefly shut down service to check for damage from the temblor, but was back up and running within five or 10 minutes, a dispatcher said.

An employee at the Reid-Hillview Airport, the closest airport to the quake's epicenter, said operations were continuing as usual there.

"We felt it, but as far as we can tell, nothing fell down, and no aircraft were damaged or buildings were damaged," he said.

The owner of Ornamental Edibles, which sells vegetable seeds out of San Jose, felt it 5810 Killarney Circle.

"There was a little precursor, a little bit of a shake and then a jolt," store owner Pam Wiggitt said, adding that nothing was damaged and business wasn't interrupted.

"By the time we looked at each other it was almost over," said Margie King, owner of MK Technical Services, a staffing agency at 4349 San Felipe Road in San Jose.

San Francisco residents also felt the quake.

"My cubicle was swaying and it took me a minute to realize it was not me or anyone walking by," said Pamela Ringer-Britz, a project manager at SFL Data at 100 California St.

"Everyone in my office felt it," she said.

A few aftershocks have been reported in the same location, including one with a preliminary magnitude of 2.6, according to the USGS.

AT&T Inc. will start selling the previous-generation iPhone -- the iPhone 3GS -- for $49 starting Friday to customers who buy the smart phone with a two-year service contract and data plan.

The wireless company, which is the exclusive U.S. carrier for the iPhone, made the announcement Thursday. AT&T said it will include iPhone 3GS devices sold through AT&T and Apple.

The iPhone 3GS was released by Cupertino, Calif.-based Apple Inc. in 2009 and had been sold for $99 by AT&T and Apple since the release of the iPhone 4 last June. It can use the same iOS4 software as the iPhone 4.

AT&T, which is based in Dallas, is currently selling refurbished iPhone 3GS' on its website for as low as $49.

Verizon reveals first '4G' tablet and phone

The first portable devices announced for Verizon Wireless' new, high-speed wireless data network are a smart phone and a tablet from Motorola, both designed to take advantage of network's speed with cameras for videoconferencing.

More devices for Verizon's "4G" network, which went live for laptop modems in December, are expected to be announced Thursday by the CEO of Verizon Communications Inc. at the International Consumer Electronics Show in Las Vegas.

For the moment, Verizon has the fastest wireless network in the country, and it's hoping to capitalize on it by selling data-hungry tablets and smart phones. There are unconfirmed reports that Verizon will also get to sell version of the iPhone, breaking AT&T Inc.'s exclusive hold, but analysts don't expect Verizon to reveal one at the show.

AT&T Inc. says it is on track to start rolling out its 4th-generation wireless network technology in the second half of this year.

CEO Ralph De La Vega updated the company's plan Wednesday. He was speaking at a developer summit in Las Vegas ahead of the annual International Consumer Electronics Show.

AT&T's speedier network uses LTE, or Long Term Evolution, technology. That is the standard technology behind 4G networks.

De La Vega also said AT&T has mostly finished its rollout of HSPA+, an upgraded 3G network that AT&T considers part of its 4G network because it offers similar speeds.

AT&T, which previously said it planned to roll out LTE in 2011, expects the new network to be largely finished by the end of 2013.

A San Francisco family on the verge of deportation to Peru was granted a six-month stay on Thursday. Their church and friends are rallying to help them stay beyond that.

Elizabeth Lee, 18, and her 16-year-old brother were brought to the U.S. from Peru by their mother 10 years ago, seeking asylum from racial discrimination.

"I didn't really understand what it was to be undocumented until 2006 when mom was suddenly arrested by immigration and my brother and I found ourselves in foster care," said Elizabeth Lee.

They were facing deportation on January 19, but on Thursday they were granted a six-month stay. Their Mission Dolores congregation, friends, immigration advocates and Elizabeth's Lowell High School principal are rallying to keep them here.

"If we together can grant this, this family will give back to our society two-fold," said Lowell principal Andrew Ishibashi.

Elizabeth graduated from Lowell last year and was accepted to UC Berkeley. Lawyers have just come on-board to help. Until now, the family had no legal representation.

"I'm very nervous about what's going to happen because if it doesn't work out, I have to go back to Peru and I have no one there. I have no family, no friends," said Elizabeth.

"When ICE grants stays like this. When the community shows what our immigration system is doing and people change their minds, it's an indication of where we can go and should go so I'm very, very hopeful for the future for this family," immigration attorney Francisco Ungarre.

San Francisco nursing student Steve Li, came to the rally. Steve was also brought from Peru as a child, and never knew he was undocumented until being deported and sent to an Arizona detention facility for two months last year. Sen. Dianne Feinstein, D- Calif., stepped in to buy him a year to make the case to stay.

"I'm still uncertain future for myself," Steve Li.

The Immigration and Customs Enforcement Agency, or ICE, says it cannot comment.

With so many investors becoming fans of the company, Facebook will be legally required to begin sharing more information about its finances and strategy by April 2012, according to documents distributed to prospective shareholders.

Some of the numbers that began trickling out Thursday were eye-popping -- most notably a net profit margin of nearly 30 percent, much higher than most people had previously speculated.

The owner of the world's largest Internet social network, privately held since it started in a Harvard University dorm room seven years ago, will be forced to open its books because it expects to have more than 500 shareholders at some point this year, according to a person who has reviewed the documents handed out Thursday. The person asked not to be identified because the documents are only being given to an elite group selected to buy a stake in Facebook through a fund packaged by the company's newest investor, Goldman Sachs Group Inc.

Surpassing 500 shareholders will catapult Facebook over a hurdle likely to lead to the company's long-awaited initial public offering of stock next year.

After a company with at least $10 million in assets has more than 500 shareholders, the Securities and Exchange Commission requires it to disclose its financial results and other details on a quarterly basis in an effort to ensure investors are adequately informed. The reporting requirement kicks in 120 days after the fiscal year in which a company exceeds the shareholder threshold for the first time.

Facebook's fiscal year ends Dec. 31, meaning it would have until late April 2012 to comply.

The company, now based in Palo Alto, could still retain a private ownership structure, but an IPO is the more probable scenario given Facebook will have to make many of the same disclosures of a publicly traded company anyway.

But Facebook founder Mark Zuckerberg, 26, has been in no hurry to take the company public, partly because he hoped to preserve a free-wheeling culture. Some analysts also think Zuckerberg, named Time magazine's person of the year for 2010, wanted to avoid the public limelight so he would have more time to mature as a leader.

To help keep the company private, Facebook sought and received an SEC exemption in 2008 that assured employees who received a class of stock wouldn't be counted toward the 500-shareholder barrier. The stock awarded those employees won't be issued until an IPO or sale of the company occurs, another factor that will pressure Zuckerberg to drop his resistance to an IPO. Zuckerberg owns about a 25 percent stake in Facebook.

Facebook spokesman Jonathan Thaw declined to comment Thursday.

Crossing the 500-shareholder barrier prompted Google to pursue its IPO in 2004 before the Internet search leader had turned six years old.

If Facebook follows a similar timeline as Google did, its IPO would probably occur during the summer of 2012.

Some of Facebook's financial information is being shared for the first time as part of the exclusive stock offering that Goldman Sachs put together in an effort to raise $1.5 billion. The minimum investment in the fund is $2 million, although some exceptions are being made for Goldman's own partners.

Some of the numbers emerging in the limited stock offering help explain why Goldman Sachs itself decided to ante up $450 million for a less than 1 percent stake in Facebook earlier this week. The investment valued Facebook at $50 billion, more than twice the current market value of Internet pioneer Yahoo Inc.

Through the first nine months of last year, Facebook earned $355 million on revenue of $1.2 billion, according to the person who reviewed the offering document. That 30 percent profit margin is in the same range as that enjoyed by Google, which posted net income of nearly $6 billion on revenue of $29.9 billion through the first nine months of 2010. Facebook produced a similar profit margin in 2009, too, with net income of $220 million on revenue of $777 million, according to the person who had seen the Goldman Sachs documents.

Like Google, Facebook is making most of its money so far by selling advertising. Facebook has emerged as a marketing magnet because it now has more than 500 million users worldwide, and the company knows a lot about them because its audience shares so much information about their interests on the website. More than 30 billion links, notes, photos and other types of content get posted on Facebook each month.

As impressive as Facebook's growth has been, just how much the business is worth remains a hotly debated topic.

The $50 billion market value implied in Goldman Sachs' investment is 25 times higher than the $2 billion in revenue that analysts believe the company had last year. Google, the Internet's biggest moneymaker so far, ended Thursday with a market value of $196 billion, about seven times its annual revenue.

Taxpayers will get an extra three days to file their federal tax returns this year, and they can thank the nation's capital for the extra time.

The filing deadline is delayed because the District of Columbia will observe Emancipation Day on Friday, April 15. The Internal Revenue Service says local holidays in the nation's capital impact tax deadlines the same way federal holidays would.

Taxpayers will have until midnight Monday, April 18, to file their 2010 returns.

Emancipation Day marks the occasion when President Abraham Lincoln signed into law a bill ending slavery in the District of Columbia. Lincoln signed the bill on April 16, 1862, more than eight months before he signed the Emancipation Proclamation, which eventually led to all slaves being freed.

If you shop in a dollar store, you might expect to pay a dollar for each item. But one store in a poor neighborhood was charging more than it advertised and giving no receipts.

For some of us, shopping the dollar store is a fun way to find cheap stuff. For others, it's a lifeline, especially in this economy. So when this dollar store charged more than it advertised, 7 On Your Side went down to find out why.

Kirby Hudgins lives in a public housing unit in San Francisco and to make ends meet, he shops at a dollar store on Market Street. At least he did until recently.

"Look at the store, it's got four big signs saying everything's a dollar, but it's not," says Hudgins. "It's false. It's unfair advertising "

Hudgins says the huge signs attract the poor with the promise that everything costs just $1, but many items actually cost more. When he complained, he says the owner brushed him off.

"It really upset me so that's why I called 7 On Your Side," he says.

So we checked it out, and sure enough, the sign says everything's a dollar, but as soon as you go in, another sign says all clothes are $1.25. Not only that, all food is $1.25, all sunglasses are $1.25, as well as walking canes, eyeglasses and all medicines.

Hudgins says it's still cheap and the extra 25 cents may not seem like much to some folks, but it means a lot to the poor who shop there.

"They see a big sign saying everything, everything's $1, so they rush into the store and everything's not $1, and I think it's just taking advantage of the poor that way," he says.

Hudgins says he didn't even realize until recently that some items cost more. The store does not give patrons a receipt. You have to ask for one ahead of time if you want one.

Shopper Lashawnda King-Talley was furious when her bill for two bags of items came to nearly $50, but there was no way to check the receipt.

"They told me they do not give receipts unless the customer asks for one," she says. "I asked for one before she even rang my things, so she threw my things on the ground."

The store re-rang the woman's order and the receipt showed she paid $1.25 for many items. Other shoppers noticed it, too.

"Well, it's kind of a misconception there," says shopper Christopher Thomas. "You're not going to get anything for just a dollar."

"No, it's not right, but when you don't have that much money, you got to shop," said shopper Nicky Starr.

We asked store owner Damoon Arman why his sign outside says everything's a dollar, when it really isn't. Arman did not want to speak on camera, but insisted the sign is correct, it's just that there are some exceptions, like all the food and all the clothes.

"The owner of the store has agreed to fix the problem and we are waiting to see that happen," says assistant district attorney Seth Steward.

It turns out the conflict caught the attention of the San Francisco District Attorney's Office, too. The district attorney told the store owner to make the sign reflect the true prices.

"He could either change the signage in the store or he could change the prices or he could remove the things that cost more than a dollar," says Steward.

So we went back to the store and the big signs were still there. However, Arman told 7 On Your Side that he indeed did change the signage, it was just very hard to see. Tiny print next to the big print says "and up."

Thousands of people lined up in 41 states and in Washington, D.C., ahead of the Mega Millions drawing on Tuesday in hopes of buying the winning ticket for the lottery game's $355 million jackpot.

The holders of a ticket sold in Idaho and another in Washington state will be sharing Mega Millions' $355 million jackpot from Tuesday night's drawing, lottery officials said Wednesday.

The prize is the fourth-largest in U.S. history and the second-largest in Mega Millions' history, said Arizona Lottery spokeswoman Cindy Esquer. The lottery's prize of $390 million in March 2007 remains the nation's richest on record.

The two winners from Tuesday will each get $177.5 million. Besides the jackpot, prizes range from $2 to $250,000.

The princely sum drew huge interest across the country as thousands of people lined up to buy tickets in 41 states and Washington, D.C., where the game is available.

Hundreds of people poured into the tiny Arizona towns of Littlefield and Beaver Dam, crossing into the state from Nevada and Utah, where Mega Millions tickets are not sold.

At Rosie's Cafe on U.S. 93 north of Kingman near the Nevada line, hundreds drove in over the weekend to buy tickets for the game.

"The line was going out the door," with 500 or more in line at times on Saturday and Sunday, said waitress and cashier Christine Millim.

Jackpot winners for the Mega Millions game have to match five regular numbers plus the "Mega ball." The winning numbers were 4, 8, 15, 25 and 47, with 42 being the "Mega ball" number.

One dollar was all it took to buy a chance at millions of dollars -- and a lofty dream.

"I'm going to take care of my family -- buy them new houses, new cars and travel a little bit," said Larry White, who bought a ticket in Atlanta.

Others said they would use the money to start foundations, retire or take vacations.

Sheila Twine, in Atlanta, said she would pay off her and her daughter's bills and help people in need.

"With all this money, I could help a lot of people," she said. Fans of the ABC television show "Lost" are having some fun with the jackpot.

Four of the six winning numbers matched those that character Hugo "Hurley" Reyes used to win a lottery on the show, only to suffer a series of spectacular misfortunes. Hurley's numbers -- 4, 8, 15, 16, 23 and 42 -- popped up throughout the show.

Mega Millions said 25,587 tickets matched three of the winning numbers, plus the bonus number -- so anyone who played the "Lost" numbers won $150 per ticket. ------

My "2010 Year In Review" - Part 7


First, I wish everyone Happy New Year! All right, let me continue my "2010 Year In Review". There were a lot of good memories during my internship for "Eye On The Bay", but at the same time I also felt helpless and lonely. Although I worked hard and tried to do the best I could, unlike my fellow interns, I was lack of appreciation. Not only lack of appreciation, there was an incident that made the relationship between one of the interns and me drifted apart. I can say those two things were actually my regrets during the internship.

It was November 15 of last year. Actually I didn't have to go to the EOTB office that day since it was Monday. Coincidentally, one of my fellow interns (who worked Mondays and Tuesdays) didn't come to the office, too. Then we chatted on Facebook because I didn't have anything to do that morning. We talked about something about living, schools and works... It was a pretty good chat at the beginning. But when I asked her why she didn't come to the office again for another week, (she was absent on the Monday of the previous week) she seemed very dissatisfied of what I asked and said,

"What do you mean by that??

I called for sick last Monday only because I felt sick. I went to work on Tuesday and they said I shouldn't have come.

My condition is getting worse, even though I have no fever now but I cough all the time and my... voice has gone. It's really irritating.

So...saying something like that is called blaming without prove. I'm not appreciated at all. And this is the second week I call sick. Last week I even went to work on Tuesday.

I'm glad that I won't be there tomorrow so that I don't have to see you. Is that clear?"


After she posted this on the FB wall, I immediately apologized to her. However, she seemed indifferent to my apology. Even though I apologized to her once again on the following day, she didn't respond positively.

After that incident, we had very few chats, and not like before, spoke our minds. Even we saw in person a few times since that incident, we just greeted each other and chatted briefly. The last day I saw her was December 7, and she left the EOTB office early that day. I have never seen her personally since then.

I always attach importance to friendship, this is my purpose in life. As long as everyone in good faith with me, I will treat them as my friends. Among friends, misunderstanding is inevitable, but I believe good faith can remove any misunderstanding. The problem is, I don't know if I'm still her friend. Nevertheless, she'll always be my friend, and it will be never changed.

 And this is the final part of my "2010 Year In Review", anything happened in 2010 has become my memory. I wish my 2011 will be another successful year to me, achieve much higher goals!
